WILLS AND LIVING TRUST ATTORNEY TAMPA (and Surrounding Areas)

Last Will and Testament

A Last Will and Testament, also known as the “Last Will” is one if not the most essential estate planning document one can have. For example, a Will allows you to name your Personal Representative (aka Executor), who is the person you appoint to manage the transfer of your Probate assets upon your death. It also allows you to name your beneficiaries and what they are to inherit as opposed to the State of Florida dictating who gets your assets when you pass away. If you would like to know what are the things you should consider when drafting a Will, read our blog post, Things to Consider When Drafting a Will.

Living Trust

A Living Trust, also known as a Revocable Living Trust, is an estate planning document that families with young children should consider having. What so important about having a Living Trust? Well, it helps you avoid Probate Court, which is the court-supervised process in transferring your assets when you pass away. Moreover, it allows you to appoint a successor Trustee in case you are unable to manage your property for whatever reason. And it avoids Guardianship Court in the case of your incapacity.
