Probate is the court-supervised process of settling a deceased person’s taxes and debt, before transferring their assets to their heirs. This process can take anywhere from 3 to 4 months up to a year or more depending on several factors such as the absence of a Last Will and Testament, the presence of creditors, if taxes owed, the number of beneficiaries present, the type of the asset, as so much more. Probate is usually held in the county where the decedent was domiciled before passing away or if the decedent was not a resident of Florida, Probate is opened in the county his or her asset is held such as real property or where the county was opened like a bank account.
